Departure of a judge from his or her position in the judiciary. The normal retirement age of judges is specified when the appointment of judges of each particular court is dealt with. For example, permanent judges and the Chief Judge of the High Court must vacate their office when attaining the retirement age of 65 years: Hong Kong Court of Final Appeal Ordinance (Cap 484) s 14(1), (11); High Court Ordinance (Cap 4) s 11A(1), (5). However, there is no retirement age for non- permanent judges: Hong Kong Court of Final Appeal Ordinance (Cap 484) s 14(3). The Chief Judge of the High Court may continue in office for so long after attaining the retiring age as may be necessary to enable him to deliver judgment or to do any other thing in relation to proceedings that were commenced before him before he attained that age: High Court Ordinance (Cap 4) s 11A(2). Where a judge retires or resigns after the hearing of a case has commenced but before the judgment has been given, it is permissible for the remaining members of the court to hand down judgment without a new trial unless there is a deadlock or unless there is a requirement that the court consist of a certain number of members: Somersetshire Drainage Cmrs v Corp of Bridgwater [1899] 81 LT 729.
