释义 | 考爾德銀行信件 A without prejudice letter containing an offer of settlement relating to any issue in the proceedings but reserving the right to disclose the letter to the court on the issue of costs, usually marked on the face of the letter ‘without prejudice save as to costs’ (‘Calderbank offer’): Calderbank v Calderbank [1975] 3 All ER 333. A Calderbank letter is given statutory recognition in The Rules of the High Court (Cap 4A) O 22 r 14. The court shall take into account an offer contained in a Calderbank letter when exercising its discretion to award costs, except where the party making the offer could have protected his position as to costs by means of a payment into court: O 62 r 5(d); Director of Buildings & Lands v Shun Fung Ironworks Ltd [1995] 1 HKC 417 (PC); Choy Bing Wing v Hong Kong & Shanghai Hotels Ltd (No 2) [1998] 4 HKC 555 (CA). This in effect means that if the offer is not accepted, and the eventual award by the court is less favourable than the terms of the offer, the party making the offer may be entitled to costs as from the date of the offer.
