释义 | 壽命預計 In the law of torts, the number of years a person is expected to live before death. An estimation of a person’s probable life span or mortality. Life expectancy is usually important evidence in assessing personal injury claims. For example, in assessing the PSLA, life expectancy was taken as one of the considerations: Lee Wai Lien, The Administratrix of the Estate of Yang Sung Po (Dec’d) v Dragages et Travaux Publics & Penta-Ocean Construction Co Ltd Trading as Dragages-Penta Joint Venture (A Firm) (HCPI 596/99, unreported). The number of years by which the plaintiff’s life has been shortened are his or her ‘lost years’. If the potential plaintiff is deceased, the legal personal representative may recover damages on behalf of the estate for loss of expectation of life and loss of earnings during the deceased’s ‘lost years’. Where the plaintiff’s life expectancy has been reduced by reason of his injuries, the multiplier for loss of earnings is calculated according to his life expectancy prior to the accident: Pickett v British Rail Engineering Ltd [1979] 1 All ER 774, [1980] AC 136 (HL).
