释义 | 契據註冊 A system under which deeds relating to property transactions or affecting land in Hong Kong are recorded on a central register, ie the Land Registry, a public office for the registration of deeds, conveyances, and other instruments in writing, and judgments: Land Registration Ordinance (Cap 128) s 2(1). Registration does not usually affect the efficacy of such instruments at law, but may be vital in establishing priority as priority is given from the date of registration: s 3(1). Registration of an instrument is effected by delivering into the Land Registry such instrument together with a memorial thereof in the form specified by the Land Registrar and by compliance with the Ordinance and the regulations: Land Registration Regulations (Cap 128A) reg 5(1). See also Deed; Priority. 就有關財產轉讓或影響在香港土地的契據,在一個中央註冊處,即土地註冊處,作出紀錄的制度;土地註冊處乃為契據、轉易契及其他書面形式的文書和判決進行註冊的公共辦事處:《土地註冊條例》(第128章)第2(1)條。註冊一般不影響該文書在法律上的效力,但對設定優先權卻可以很重要,因為優先權是在註冊日獲給予的:第3(1)條。要進行文書註冊,須將該文書連同該文書的註冊摘要,以土地註冊處處長所指明的格式交付土地註冊處,並且須符合該條例及該規例的規定:《土地註冊規例》(第128A章)第5(1)條。另見 Deed; Priority。 |
