释义 | 故意損毀 The deliberate and intentional despoiling of land or property by a tenant for years or life, to the prejudice of those in reversion or remainder, whose remedy is to bring an action for damages or to apply for injunction: Woodhouse v Walker (1880) 5 QBD 404. A tenant at will is liable for damage to the premises caused by his own wilful act: Harnett v Maitland (1847) 16 M & W 257. If a tenant for life profits from wilful waste (for example, cutting timber), that tenant may be made liable for the money or value consequently received: Seagram v Knight (1867) 2 Ch App 628; Dashwood v Magniac [1891] 3 Ch 306. Wilful destruction of the premises constitutes voluntary waste: Manchester Bonded Warehouse Co v Carr (1880) 5 CPD 507.
