释义 | 押貨預支協議 An arrangement by which a security interest in property of a borrower is given to the lender. It merely acts as an encumbrance on title. It is created when the debtor indicates that particular property is to be available on default of his obligations to repay a debt. It is a charge which involves no transfer of proprietary interest in, or of possession of, the property as security for the loan. Instead, the property is merely designated as that which can be taken in execution of the debt on default: Sihombing & Wilkinson, A Student’s Guide to Hong Kong Conveyancing (2nd Ed, 1997) Ch 13, pp 759-60. However, the creditor has a right to foreclosure: Askrigg Pty Ltd v Student Guild of Curtin University of Technology (1989) 18 NSWLR 738. An hypothecation agreement is more commonly referred to as a charge or lien, except in the context of shipping law where a letter of hypothecation is used to refer to an agreement by which an exporter is given security over goods which have been shipped: Cargo ex Sultan (1859) Swa 504, 166 ER 1235.
