释义	法律錯誤 Ignorance of or an inadvertence to the existence or operation of statutory provisions. See also Mistake; Mistake of fact. Restitution - A mistaken understanding of the law as opposed to a mistake of fact. Traditionally restitution has not been available in cases of mistake of law. In company winding up cases, where the taxation of fees as obtained by the provisional liquidators and granted by the Registrar under a mistake of law, the entire exercise will be accordingly held as a nullity: Re Peregrine Investments Holdings Ltd & Ors (No 3) [1999] 3 HKC 183. A misunderstanding of the law will nullify a guilty plea only in situations where the facts as admitted do not amount to the offence in respect of which the plea is tendered or where the charge for which the plea is entered is defective. In all other circumstances, a misunderstanding of the law should not be treated as being able to nullify a plea, just as a mistake of law on the part of a contractor in a contract case does not vitiate his intent in entering into the contract: HKSAR v Wong Chi Yuk [2000] 2 HKC 158 (CA).
