A set of rules that describes the defence of insanity in common law jurisdictions, deriving from M’Naghten’s case (1843) 10 C1 & Fin 200, 8 ER 718; R v Chan Tak Kwong [1997] 1 HKC 478. The rules provide the requirement for the common law defence of insanity that at the time of committing the act the accused was labouring under such a defect of reason, owing to disease of the mind, as not to know the nature and quality his or her act, or, if the accused did know it, he or she did not know that what he or she was doing was wrong. A temporary state of intoxication is not a disease of the mind: R v Quick [1973] QB 910. In respect of a person suffering insane delusions as to some peculiar fact but in other respects sane, he or she should be consider in the same situation as to responsibility as if the facts with respect to the delusion were real.
