释义 | 議價能力 The ability of a party to a transaction to achieve results desired by that party. Bargaining power is derived from the resources and advantages a party may have. Examples of this include the existence of attractive alternatives to the transaction, financial resources, possession of good negotiation skills and the position that a party may hold. The strengths of the bargaining positions of the parties relative to each other is a factor which the court would consider in determining whether a contract term in consumer contracts satisfies the test of reasonableness in the Control of Exemption Clauses Ordinance: Control of Exemption Clauses Ordinance (Cap 71) sch 2. In determining whether a contract or part of a contract is unconscionable, the court may also have regard to the relative strengths of the bargaining positions of the consumer and the other party: Unconscionable Contracts Ordinance (Cap 458) s 6.
