An impression of a finger which may be used for the purpose of proving the identity of persons. Where a person has been arrested under powers conferred under the law a police officer may take or cause to be taken under the supervision of a police officer the fingerprints, palm prints, sole prints or toe prints of such person: Police Force Ordinance (Cap 232) s 59(1)(a), (b). The power to take fingerprints has also been given to officers of the Independent Commission Against Corruption and the officers of the Immigration Service: Independent Commission Against Corruption Ordinance (Cap 204) s 10; Immigration Service Ordinance (Cap 331) s 14. A person may be convicted even where fingerprints are the only evidence of identity, as courts have taken judicial notice of the fact that no two people have identical fingerprints: R v Castleton (1909) 3 Cr App Rep 74.
