释义 | 大律師 A class of legal practitioner who is by law or custom limited to advocacy and advisory work, in any field of law. A barrister is a person who is enrolled as a barrister on the roll of barristers and who, at the material time, is not suspended from practice: Legal Practitioners Ordinance (Cap 159) s 2. A barrister has exclusive right of audience in the superior courts, the High Court and the Court of Final Appeal: Brentwood Wig Manufactory Ltd & Ors v Richard F Poncher & Anor [1965] HKLR 1042. A barrister who intends to practise is required to spend at least twelve months (the prescribed period of active practice) as a pupil with a junior barrister who has for not less than five years continuously practised at the Bar in Hong Kong, unless an exemption was granted by the Court or the Bar Council: Code of Conduct for the Bar para 29; Legal Practitioners Ordinance (Cap 159) s 31(1)(a). After completing 6 months of the prescribed period of active practice, the pupil may starts his or her ‘limited practice’: Legal Practitioners Ordinance (Cap 159) s 30(1)(a); Code of Conduct for the Bar, paras 29(b), 63 and Annex 5. The procedure when one seeks to be a pupil: Barristers (Qualification) Rules (Cap 159E). The bar is comprised of junior barristers and Senior Counsel. Also known as ‘counsel’.
