| 释义 | 過敏原告人 A plaintiff with a particular susceptibility which results in a tortious injury or damage caused to the plaintiff being greater than that suffered by a plaintiff with normal sensitivity; or in a non-tortious act which would not ordinarily cause injury, injuring the hypersensitive plaintiff. In general, a defendant will be liable to the full extent for any injury or damage caused. However, if the defendant’s act or omission is not tortious, but causes harm to the plaintiff owing to the plaintiff’s hypersensitivity, liability will not arise unless the defendant was aware of the plaintiff’s condition and as a result could have avoided harming the plaintiff. 因原告人的特別敏感度，而引致原告人蒙受的侵權傷害或損失，比僅有正常敏感度的人士會蒙受的嚴重；或在一般不會引致受傷的非侵權行為中，引致過敏原告人受傷。概括而言，被告人會就所引致的傷害或損害負上全部的法律責任。但如被告人的行為或不行為並非具侵權性質，而只因原告人的過敏才引致原告人受傷，則被告人不會負有法律責任，除非被告人知悉原告人的情況，而本應可避免傷害原告人，則屬例外。 |
