| 释义 | 有欺詐成份的轉易 A conveyance of property made with intent to defraud the transferee, on the basis of a falsified or fraudulently concealed title: for example Markfaith Investment Ltd v Chiap Hua Flashlights Ltd [1990] 2 HKLR 84 (PC) (concealed the option to renew tenancy by existing tenants). The conveyance may also be made with the intention to delay or defraud creditors, where such intention is known to the party to whom the conveyance is made. It is characterised by a lack of fair and valuable consideration and is made by a debtor to place his property beyond reach of creditors: for example Re Lo ShouPea (A Bankrupt), ex p The Official Receiver v Wong TingSau [1966] HKLR 276. Such disposition will be voidable under the Conveyancing and Property Ordinance (Cap 219) ss 60, 61, unless the property has been disposed of for valuable or good consideration and in good faith to any person not having, at the time of the disposition, notice of the intention to defraud: Sihombing & Wilkinson A Student’s Guide to Hong Kong Conveyancing (1997) ch 5, p 298.
