| 释义 | 證明文件／證書 A written document setting out certain facts. It may be a declaration, attestation or a simple record under hand. See also Attestation; Certificate of damage; Certificate of registration. Building and construction - In building law, an expression of a determination or judgment by an engineer, architect or a surveyor on the terms of a building contract, and recorded in definite form: Token Construction Co Ltd v Charlton Estates Ltd (1973) 1 BLR 48. A particular feature of a building contract is the provision that the rights of the parties be determined, at the outset at least, by the decision of a third party and recorded by a certificate. Examples are a ‘progress certificate’ and a ‘final certificate’. The Building Authority may issue various certificates to owners of buildings or lands certifying that certain works such as works in relation to dangerous buildings, defective buildings, dangerous hillsides, water pipes, drains or sewers laid in slopes, or drainage have been carried out by the Building Authority for which the Building Authority may seek to recover the costs of doing so against the owners: Building Ordinance (Cap 123) ss 26-28. The Building Authority may issue a certificate to the owner of a building showing that a building should be closed in order to enable building works to be carried out without danger to the occupiers or the public, for the purpose of applying for a Closure Order from the District Court: s 27. On registering or provisionally registering a school, the Director of Education is required to issue to the supervisor a certificate of registration or certificate of provisional registration: Education Ordinance (Cap 279) ss 13, 18.
