| 释义 | 租費 Any annuity or periodic sum of money charged upon or payable out of land: Limitation Ordinance (Cap 347) s 2(1). It is an incorporeal right in gross in land whereby the grantee of the rent charge is entitled to collect rents from the land but has no tenure in the land. If a person is entitled to receive rent, he will be in continuous possession of the land by reason of the receipt of the rent, despite letting out the land: Tang Kwan Tai v Tang Koon Lam & Anor [2002] 3 HKLRD 762; 4 HKC 482. A rentcharge often will be created in the form of a mortgage or charge. It is not usual in Hong Kong because alienated land is held by way of leasehold and the term of that leasehold is finite.
