释义 | 類似需役地 Land that enjoys the benefit of a quasi-easement. An owner cannot have easement over his own land. But where an owner has been accustomed to using one part of his land in a particular way, which is of the benefit to the rest of his land, his use is commonly termed a quasi-easement: Nield, Hong Kong Land Law (2nd Ed, Longman) ch 13 p 331. The right is similar to an easement. The land enjoying the right is the quasi-dominant tenement. The land bearing the burden is the quasi-servient tenement. If the owner sells the quasi-dominant tenement, the purchaser acquires by implication of law an easement with rights corresponding to the quasi-easement. If both parcels are sold contemporaneously to separate purchasers, then the purchaser of the quasi-dominant tenement acquires the benefit of the easement, and the purchaser of the quasi-servient tenement acquires the burden of the easement.
