In relation to animals, unnecessarily causing any suffering to an animal: Budge v Parsons (1863) 3 B & S 382, 122 ER 145; Elliot v Osborn (1891) 65 LT 378; Swan v Saunders (1881) 14 Cox CC 566, 50 LJMC 67. A person cruelly ill-treats an animal where he wilfully causes pain to it without justification: Barnard v Evans [1925] 2 KB 794; R v Ng Yau Fai (CACC 1055/86, unreported). The Prevention of Cruelty to Animals Ordinance (Cap 169) prescribes offences of cruelty to animals. 2. A ground for divorce under previous English family law. See also Baiting; Dissolution. Family law - Conduct which causes injury to health or a reasonable apprehension of such danger: Russell v Russell (1897) AC 395 (HL); C v C [1971] HKLR 56. Where a married person has been guilty of persistent cruelty to the other party to the marriage or to that party’s children, the other party may apply to the court for a separation order, or an order relating to the custody of the children or maintenance: Separation and Maintenance Ordinance (Cap 16) s 3(1)(d). Examples of cruelty include assaults, criminal offences, sexual perversion, nagging, neglect, indifference, wilful refusal to provide maintenance.
