Plant culture |
Plant tissue developed, otherwise than as a whole plant, in an artificial medium. As such, plant culture is inherently a product of human intervention, and prima facie patentable subject matter, even if it comprises only the cultivated cells of a naturally occurring plant. The technique facilities controlled genetic manipulation of the cells, thus providing a powerful tool for developing new plant varieties. A plant culture is a ‘micro-organism’ within the meaning of the Budapest Treaty on the International Recognition of the Deposit of Micro-organisms for the Purposes of Patent Procedure 1977 art 2 and must be fully described for the purposes of a patent specification by depositing a sample with an International Depository Authority. See also Manner of manufacture; Patentability. 另見 Manner of manufacture; Patentability。 |
