A tenancy agreement for a certain term. A tenancy cannot arise as a matter of law unless it is granted for a certain term: Guoji Transport Co Ltd v The Collector of Stamp Revenue [1997] 1 HKLRD 1168 (DC); Har SioYing (aka Law Har SioYing) v Chung Yau-cheung [1987] HKLR 411 (HC). At common law a tenancy for a fixed term expires automatically at the end of that term and, subject to any agreement between the parties to the contrary, is determined by the effluxion of time alone, without the need for any other act or notice. However, certain domestic tenancies and business tenancies have been afforded a measure of security of tenure by the statutory continuation of those tenancies after the end of the contractual term, ie new tenancies of domestic premises and tenancies of business premises respectively under the Landlord and Tenant (Consolidation) Ordinance (Cap 7) Pts IV, V: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.187]. In the circumstances, the tenant becomes a tenant at sufferance until the landlord determines the tenancy in accordance with the relevant provisions under Landlord and Tenant (Consolidation) Ordinance (Cap 7).
