An item of tangible personal property which has become physically attached to land and become part of the land, such that its removal would damage the property: Hellawell v Eastwood (1851) 6 Ex 295. Whether an item is a fixture depends on the degree and purpose of annexation: for example Goldful Way Development Ltd v Wellstable Development Ltd [1999] 1 HKLRD 563, [1998] 4 HKC 678. It would also depend on whether it was for the permanent and substantial improvement of the dwelling: for example Irene Loong v Pun TsunHang, American Engineering Corp Fed Inc v Far East Import & Export Ltd [1959] DCLR 192. Ownership of a fixture follows ownership of the land and an item which is a fixture thus ceases to be personal property of the person who attached it in the first place: for example Orient Leasing (Hong Kong) Ltd v N P Etches & Ors [1985] HKLR 292 (HC).
