释义 | 對物訴訟 Lat – in rem – against the thing. Actions involving or determining the status of a thing which involves the enforcement of the right against a thing, as opposed to action in personam (action against a person) within the jurisdiction of the court. It is because the location of the property determines which court has jurisdiction and enforcement of a judgment must be upon the property and does not follow a person. A term usually engaged in admiralty proceedings: The Rules of the High Court (Cap 4A) O 75 r 3. In most cases where the Admiralty Court has jurisdiction, the plaintiff can bring an action in rem by serving a writ on the ‘particular’ vessel. Also known as ‘action in rem’.
