| 释义 | 普通居所 1.Habitual or permanent residence in contrast to a casual or occasional place of residence of long or short duration: R v Barnet London BC, ex p Shah [1983] 2 AC 309, 1 All ER 226 (HL); Levene v IRC [1928] AC 217 (HL). Whether an individual is ordinarily resident in Hong Kong is a question of fact and must be decided by examining his pattern of life over a number of years and, unlike domicile, concepts of intention and abandonment have little significance: Director of Immigration v Ng Shun-loi [1987] 2 HKLR 798 (CA). Factors such as repeated visits for substantial periods and the maintenance of a place of abode are often relevant in establishing residence. However, mere residence, which may be only temporary, is not the same as ordinary residence: Re Application for Admission by a Barrister [1981] HKLR 574; R v Liu Apollonia, ex p Lau San-ching (1994) 4 HKPLR 415. 2. A corporation is ordinarily resident where it has its central management and control and it may be ordinarily resident within the jurisdiction and elsewhere: Swedish Central Rly Co Ltd v Thompson [1925] AC 495 (HL); Artemis (Cargo Owners) v Artemis Transportation Corp and Barber Ship Management Ltd (The Artemis) [1983] HKLR 364, 1 HKC 46 (CA).
