| 释义 | 多配偶制婚姻 A marriage that has been validly celebrated under a law which permits the husband to take more than one wife during the subsistence of that marriage, regardless of whether he actually takes one or not: Re Bethell, Bethell v Hildyard (1888) 38 Ch D 220. It is the lex loci celebrationis which determines whether the marriage is monogamous or polygamous: Hussain v Hussain [1983] Fam 26, [1982] 3 All ER 369 (CA). The capacity to enter into a polygamous marriage is governed by the ante-nuptial domicile of each party: Ali v Ali [1966] 1 All ER 664, [1968] P 564. Where there is the capacity to enter into a polygamous marriage, and it is valid as such by the lex loci celebrationis, it is a valid marriage for all purposes: Shahnaz v Rizwan [1964] 2 All ER 993, [1965] 1 QB 390.
