释义 | 不在犯罪現場的通知 A notice given by the accused following committal for trial in the High Court or on being transferred to the District Court for trial in which the accused gives the name and address of any witness who is to be called at the trial to give evidence of alibi and the nature of the evidence which the witness would give: Criminal Procedure Ordinance (Cap 221) s 65D. The notice must be in writing: s 65D(6). The notice has to be given within a prescribed period after committal or before trial. Where a notice of alibi contains no admission against the interests of the maker of the statement it is not probative of the truth of the contents, the jury should not be invited to consider whether what it contained was true or false and to measure the truth of the prosecution witness’ evidence: Leung Kam Kwok v The Queen [1986] HKLR 181, 81 Crim Rep 83 (PC).
