| 释义 | 保費收據 The receiving of money due and payable under an insurance policy. An insurance policy may provide that an insurer’s liability is conditional upon actual receipt of premium: Equitable Fire and Accident Office v Ching Wo Hong [1907] AC 96 (PC). Where the insurer has delivered an insurance policy acknowledging receipt of premium, the insurer is liable, irrespective of whether the premium has actually been received: Roberts v Security Co [1897] 1 QB 111. Where a marine policy effected on behalf of the assured by a broker acknowledges the receipt of the premium, such acknowledgment is, in the absence of fraud, conclusive as between the insurer and the assured, but not as between the insurer and the broker: Marine Insurance Ordinance (Cap 329) s 54.
