释义 | 一般損害 Damage which is presumed to arise as a result of the breach of an absolute right (a right the breach of which gives rise to an action without proof of damage). Breach of the right is considered damage enough in itself: Ratcliff v Evans [1891-4] All ER Rep 699, [1892] 2 QB 524 (CA). General damage includes all other items of damage, apart from past pecuniary loss which is calculated at the date of a trial, whether pecuniary or not: Halsbury’s Laws of Hong Kong, Vol 5, Civil Procedure [90.0392]. General damage is the damage which the law implies in wrongs actionable per se. It arises by inference of law. As a general principle, general damage need not be specifically pleaded: [90.0391].
