释义 | 原始證據 Primary evidence, which does not by its very nature suggest that better evidence may be available; for example, the original of a document. At common law, a party must produce the best evidence that the nature of his or her case will allow: Omychund v Barker (1744) 1 Atk 22, 26 ER 15. However, the operation of the rule is now largely limited to the proof of documentary evidence, requiring the production of the original: Garton v Hunter [1969] 1 All ER 451. If an original document is available in one’s hands, one must produce it; that one cannot give secondary evidence by producing a copy: Kajala v Noble (1982) 75 Cr App R 149.
