| 释义 | 保險經紀 A person who carries on the business of negotiating or arranging contracts of insurance in or from Hong Kong as the agent of the policy holder or potential policy holder or advising on matters related to insurance: Insurance Companies Ordinance (Cap 41) s 2. A person who, acting with complete freedom as to his choice of undertaking, brings together, with a view to the insurance or reinsurance of risks, persons seeking insurance or reinsurance and insurance or reinsurance undertakings carries out work preparatory to the conclusion of contracts of insurance or reinsurance and, where appropriate, assists in the administration and performance of such contracts, in particular in the event of a claim: Halsbury’s Laws of Hong Kong, Vol 11, Agency [15.001]. A person is not entitled to conduct a business as an insurance broker unless it is authorised by the Insurance Authority: s 69(1). An insurance broker who negotiates an insurance policy between the assured and the insurer is prima facie the agent of the assured and not of the insurer: Wong Wing Tak (t/a Loi Kee Marine Store) v Euro-America Insurance Ltd [1995] 1 HKC 88 (HC). The broker will procure appropriate policies of insurance to protect his or her clients against risks of loss. Once a policy is effected, the broker is entitled to have a lien over the policy for the amount of premium and his charges owed to him by the insured: Marine Insurance Ordinance (Cap 329) s 53(2). A broker is entitled to brokerage from the insurer. The duties of a broker after the insurance contract was made include giving advice as to the meaning of the policy (Baron v Hartford Fire Insurance Co & Ors [1998] 1 HKLRD 411 (CFI)) and submitting any claim to the insurer (Comber v Anderson (1808) 1 Camp 523).
