释义	保險代理人 A person who holds himself out to advise on or arrange contracts of insurance in or from Hong Kong as an agent or subagent of one or more insurers: Insurance Companies Ordinance (Cap 41) s 2. A person instructed or empowered to act in the name and on behalf of one or more insurance undertakings in introducing, proposing and carrying out work preparatory to the conclusion of or in concluding contracts of insurance, or in assisting in the administration and performance of such contracts: Law Reform Commission of Hong Kong, Report on Laws on Insurance (Topic 9); EC Insurance Intermediaries Directive. No person shall hold himself as an insurance agent unless he or she is registered as an appointed insurance agent under the Insurance Companies Ordinance (Cap 41) s 65(1)(a) with an agency agreement in force with the insurer. An appointed insurance agent is the agent of the insurer: s 68(1). An insurer’s responsibility for the appointed insurance agent’s acts and omissions is similarly governed by the general law of agency: Halsbury’s Laws of Hong Kong, Vol 1, Agency [15.001]. An insurer is not able to exclude or limits its liability for the actions of its appointed insurance agents in the dealings for the issue of a contract of insurance and insurance business relating to the contract: s 68(2). A person shall not be an appointed insurance agent and an authorised insurance broker at the same time whether in relation to the same or different clients: s 65(3).
