Intangible loss |
A form of non-economic loss. Intangible loss may include indignity sustained by a plaintiff, the loss of enjoyment of life and loss of self-esteem. It is compensated by a general damages award: Marsh v Marsh (1994) 17 Fam LR 289. In equal opportunity cases, for example, it is impossible to assess the monetary value of the injured feelings, but the award should not be minimal as it would trivialise or diminish respect for the public policy: Ma Bik Yung v Ko Chuen [1999] 1 HKC 714, 2 HKLRD 263 (DC). See also Economic loss; General damages; Negligence. |
