Its execution takes place when it is signed: Halsbury’s Laws of Hong Kong, Vol 24, Taxation and Revenue [370.375]. Instrument under hand includes a written contract, and it is distinct from an ‘instrument under seal’, in which it is not sealed; it is also distinct from a deed, in which it need not meet the formal requirements of a deed. An instrument that fails as a deed may nevertheless be a valid instrument under hand: Windsor Refrigerator Co Ltd v Branch Nominees Ltd [1960] 2 All ER 568, [1961] Ch 88.
