In property law, a limitation on an estate whereby it only vests an interest upon the happening of some event or condition which may or may not take place until some time after the preceding estate. A contingent remainder of a freehold estate had to vest during the continuance of a prior particular estate, or at the precise moment when the estate determined, otherwise, it will fail. Statutory enactment now allows contingent remainders to create an equitable interest which is as effective as if they had been created as a legal interest as by a shifting use (an existing use which ‘shifts’ from one person to another on the happening of some event) or by an executory devise. Partly as the result of the foregoing, ‘contingent remainder’ is frequently referred to as a ‘remainder subject to a condition precedent’.
