Continuing act |
In criminal law, conduct or a series of acts and circumstances constituting an offence, as distinct from a single act. For example, illegal entry upon premises by a person who also intends to commit other acts such as theft (burglary) or rape to persons on the premises: R v Walkington [1979] 2 All ER 716 (CA). Sexual intercourse is a continuing act and thus if the woman revokes her consent during the course of the act of intercourse, further intercourse with the appropriate mens rea is rape: Kaitamaki v R [1985] AC 147, [1984] 2 All ER 435. See also Actus reus. |
