释义 | 虧空 A misapplication, including misappropriation, of any property: Securities and Futures Ordinance (Cap 571) sch 1 pt 1 s 1. Any defalcation committed by the specified person (defined as an intermediary licensed for dealing in securities or dealing in future contracts or for securities margin financing, or by an authorised financial institution which provides securities margin financing) or by associated person of the specified person (defined as a person employed or engaged by the specified person; a person who may receive or hold client assets of the specified person or an employee of such person), results in a default: Securities and Futures (Investor Compensation – Claims) Rules (Cap 571T) r 2. The Securities and Futures Commission (SFC) may appoint one or more persons to investigate any defalcation if SFC has reasonable cause to believe that the defalcation may have taken place and that the manner in which a person has engaged or is engaging in that defalcation is not in the interest of the investing public or in the public interest: Securities and Futures Ordinance (Cap 571) s 182. 指不當地運用(包括挪用)任何財產:《證券及期貨條例》 (第571章)附表1第1部第1條。指明人士(指就證券交易或期貨合約交易獲發牌的中介人;或就證券保證金融資獲發牌的中介人;或提供證券保證金融資的認可財務機構)或指明人士的相聯者 (指受指明人士僱用或以其他方式聘用的人;收取或持有該指明人士的客戶資產的人;或該指明人士的僱員)觸犯的任何虧空,即構成過失:《證券及期貨 (投資者賠償—申索)規則》 (第571T章)第2條規則。如證券及期貨事務監察委員會有合理因由相信可能曾發生虧空行為或某人從事該等活動的方式並不符合投資大眾的利益或公眾利益,則證監會可委任多於一名人士調查任何有關的虧空行為:《證券及期貨條例》 (第571章)第182條。n. |
