In family law, a written agreement executed by the parties to a marriage setting out terms on which they agree to cease to cohabit. Such a deed may deal with spousal and child maintenance, settlement of property, and the residence and contact with the children of the marriage subject to the Matrimonial Proceedings and Property Ordinance (Cap 192) s 14 (relating to maintenance agreements). The court has jurisdiction to entertain a wife’s application for a lump sum payment and to make an order on it, notwithstanding her covenant in a deed of separation not to proceed with such a claim: Edgar v Edgar [1980] 3 All ER 887, 1 WLR 1410 (CA); Annotated Ordinance of Hong Kong Matrimonial Proceedings and Property Ordinance (Cap 192) para 4.10. Spouses living apart under a duly executed deed of separation are deemed to be living apart for the purposes of taxation: Inland Revenue Ordinance (Cap 112) s 2(3).
