The meaning of an expression or image assessed as injurious to a person’s reputation in light of the ‘understanding of the hypothetical referees who are taken to have a uniform view of the meaning of the language used, and upon the standards, moral or social, by which they evaluate the imputation they understand to have been made’. The test is an objective one, namely whether a reasonable man of ordinary intelligence and with ordinary knowledge and experience of all the affairs would be likely to understand the publication in a libellous sense. The meaning intended by the person making the statement is irrelevant: Cassidy v Daily Mirror Newpapers Ltd [1929] All ER Rep 117, 2 KB 331; Easy Finder Ltd v Oriental Daily Publisher Ltd & Anor [1997] 3 HKC 348. At trial, the judge has to decide whether the words complained of are reasonably capable of bearing a defamatory meaning and it would be left to the jury to be decided as a question of fact: Slim v Daily Telegraph Ltd [1968] 1 All ER 497, 2 QB 157 (CA); Oriental Daily Publisher Ltd v Next Magazine Publishing Ltd [1999] 2 HKC 678 (CA).
