释义 | 誹謗性質的發布 The communication of defamatory material to someone other than the subject of the defamation. Defamatory statements are actionable only if they have been published. Publication to a single third person will suffice, for example to a stranger, or to the plaintiff’s wife or husband: Wenman v Ash (1853) 13 CB 836. Where defamatory material is unintentionally published, the publishers will not be liable if they can show that they could not reasonably have anticipated that a third party would read the statement: Theaker v Richardson [1962] 1 All ER 229, 1 WLR 151 (CA). Words shall be treated as published by one person (publisher) innocently in relation to another person if and only if the publisher did not intend to publish them of and concerning that other person, and did not know of circumstances by virtue of which they might be understood to refer to him: Defamation Ordinance (Cap 21) s 25(5)(a).
