| 释义 | 明示一事即排除他事 Lat – express mention of one is the exclusion of the other. A rule of construction of statutes and instruments requiring the exclusion of matters not expressly mentioned. This rule must be applied with caution. It can only apply if it is clear that the provision in question was intended to make exhaustive provision with respect to the topic concerned and the exclusion of matters not expressly mentioned is not due to inadvertence or accident. It cannot apply where inconsistency or injustice will result: Matheson PFC Ltd v Jansen [1994] HKC 250 (CA); The Cheung Hing Co v Tang Hau Cho [1950] 34 HKLR 128; Lai Chi Kok Amusement Park Co Ltd v Tsang Tin Sun (No 2) [1966] HKLR 124.
