释义 | 在別處未決的訟案 Lat – a suit pending elsewhere. A proceeding, suit, or case pending in another jurisdiction. If a dispute between a plaintiff and defendant regarding a specific issue is lis alibi pendens, the defendant may invoke this fact as a ground to prevent the plaintiff from instituting the same suit in another court against the defendant. Where an action is pending in a foreign court, and a second action is begun in Hong Kong between the same parties claiming substantially the same remedy or relief, the court may put the plaintiff to his election with which action he will proceed (Hing Fat Plastic Manufacturing Co Ltd v Advanced Technology Products (HK) Ltd [1992] 2 HKLR 350); or stay all proceedings in Hong Kong (Securities and Futures Commission v Nomura International (Hong Kong) Ltd & Ors [1998] 2 HKC 503, 1 HKLRD 835 (CA)); or grant an injunction restraining the prosecution of the foreign proceedings (Hui Kao Chu v Wu Chi Cheung [1984] 1 HKC 273 (HC)). The doctrine of lis alibi pendens will not apply when the foreign action is or is virtually at an end or halted: Buttes Gas and Oil Co v Hammer & Anor [1971] 3 All ER 1025 (CA).
