释义 | 實際知情 The knowledge that a person as a matter of fact had or has with regard to a course of events or a particular situation even where one turns a blind eye to the facts, or deliberately refrains from making inquiries: Rolled Steel Products (Holdings) Ltd v British Steel Corp & Ors [1986] Ch 246 (CA); Knox v Boyd [1941] JC 82. The test of actual knowledge is subjective and a question of fact: Swinton v China Mutual Steam Navigation Co Ltd (1951) 83 CLR 553. It is contrasted with ‘constructive knowledge’.
