释义 | 道德上的責任 The duty which a testator owes to his family members and/or dependants to provide for them on his death: Bosch v Perpetual Trustee Co [1938] AC 463, 2 All ER 14. The court has inherent power to make orders when it is satisfied that the deposition of the deceased’s estate effected by his will or the law relating to intestacy, or the combination of his will and the law, is not such as to make reasonable financial provision for the applicant: Inheritance (Provision for Family and Dependants) Ordinance (Cap 481) ss 3,4. In adopting a moral duty approach in relation to whether an applicant was left without adequate provision, the court may take into account the means and needs of the applicant, the size of the estate and the extent of competing claims: s 5(1). The test is simply whether the will or the deposition has made reasonable provision: Re Coventry, Coventry v Coventry [1979] 3 All ER 815 (CA).
