In criminal law, a cut or abrasion that pierces the outer and inner layers of skin (R v Payne (1831) 4 C & P 558), including a cut in the mouth (R v Waltham (1849) 3 Cox CC 442). To constitute a wound in a wounding offence, the continuity of the skin must be broken: R v Wood (1830) 1 Mood 278. It is the whole skin, not merely that of the cuticle or upper skin, that must be divided: R v M’Loughlin (1838) 8 C & P 635. The skin broken need not, however, be external. A division of the internal skin, such as within the cheek or lip, is sufficient: R v Warman (1846) 1 Den 183. For example, a 3-cm superficial laceration is sufficient to constitute a wound as there has been a break in the continuity of the skin: R v Lau Ting Kwok (CACC 425/88, unreported).
