释义 | 潛在疾病 1. A disease, such as mesothelioma or certain cancers, that is not manifested through symptoms of illness until a considerable period following exposure to, or use, or consumption of a product that has or may have caused the disease: Cartledge v E Jopling & Sons Ltd [1963] AC 758. 2. In the context of medical negligence, a disorder of body or mind not patent or apparent by reasonable examination; a pre-existing medical condition which the plaintiff may be under a duty to disclose, or which may amplify a plaintiff’s injury. 3. In case an accident or a new cause brought out the pre-existing condition which was latent in the body, but the condition would not have manifested itself but for the accident or the new cause, the disablement must have been proximately caused by the accident or the new cause: Fidelity and Casualty Co of New York v Mitchell [1917] AC 592.
