释义 | 結構上的改動 An alteration of a permanent character affecting the form or structure of the building: Montana Lands Ltd v Leung Siu Kim [1967] HKLR 475; Koo Cheuk Son v Tang Wai Chun [1963] HKLR 891. ‘Structural’ means something which involves the fabric of the building as opposed to the provision merely of a piece of equipment. It matters not whether the fabric in question is load-bearing or otherwise: Pearlman v Keepers and the Governors of Harrow School [1979] 1 QB 56 (CA). ‘Alteration’ is limited to something which alters the form or structure of the building: Bickmore v Dimmer [1903] 1 Ch 158. The ‘form’ of a building has to do with its appearance or visual aspect and the meaning given to the word ‘structural’ was its natural and ordinary meaning rather than some special or technical meaning: The Incorporated Owners of Elite Garden v Profit More Co Ltd (CACV 3622/2001, unreported); The Incorporated Owners of Yee Fung Garden v Basic Tech Ltd (HCA 6622/98, unreported). ‘Structural alteration’ must be an alteration of a permanent character affecting the form or structure of the building. Structural alteration is included in the definition of ‘improvement’ under the Landlord and Tenant (Consolidation) Ordinance (Cap 7) ss 10, 55A.
