| 释义 | 次受託保管 A situation arising when a person (the sub-bailee) receives temporary possession of goods from a prior bailee (the sub-bailor or intermediate bailor) rather than from the original bailor: Kahler v Midland Bank Ltd [1950] AC 24, [1949] 2 All ER 621 (HL). Where the bailor has expressly or impliedly consented to a sub-bailment and the terms of such a sub-bailment, the bailor will also be bound by the terms of the agreement of sub-bailment even though he or she is not a party to such an agreement: Morris v CW Martin & Sons Ltd [1965] 2 All ER 725, [1966] 1 QB 716 (CA), The Mahkutai [1993] 2 HKC 71. However, where the existing bailee ceases to owe any duty to the bailor, with or without attornment to the bailor by the new bailee, there is not a sub-bailment but what is known as a ‘springing bailment’ or ‘substitutional bailment’.
