| 释义 | 分期繳付合約 A contract under which the balance of the purchase price is payable by separate fixed amounts at successive fixed periods. Contract - A contract which provides for the payment of money, over time, by instalments. There are three main forms: a promise to make periodic payments for an executed consideration (for example a loan contract under which principal and interest are payable by instalments (China Merchants Bank v Minvest International Ltd & Anor [2002] 1 HKLRD A9(CFI)); a conditional sale contract, under which the purchase price is payable by instalments and ownership of the subject matter of the contract is to be transferred on payment of the final instalment (for example Century Main Investments Ltd v Polyline Development Ltd & Anor [2002] 1 HKLRD B7 (CFI)); a severable contract which fixes an amount to be paid at specified intervals for the use of land or goods, for services rendered, work done or for goods supplied which are to be paid for by stated instalments (for example Padilla Chien Mateo v Chan Choi Hing [1997] HKLRD 539 (HC)). A plaintiff may sue for and recover each payment as it falls due.
