| 释义 | 香港水域 All waters, whether navigable or not, included in the Hong Kong Special Administrative Region: Interpretation and General Clauses Ordinance (Cap 1) s 3. It includes all inland waters, territorial waters and tidal waters, and the flora and fauna thereof: Water Pollution Control Ordinance (Cap 358) s 2(1). Waters of Hong Kong is divided into different areas under the Shipping and Port Control Regulations (Cap 313A): Restricted Area, Reserves, and Special Anchorages. The Director of Environmental Protection may designate an area within Hong Kong waters as a marine dumping area and publish a notice in the Gazette: Dumping at Sea Ordinance (Cap 466) ss 4, 7. Any act of any person, whatever the citizenship or nationality of the person, which takes place in the waters of Hong Kong on board, or is committed in such waters by means of, a ship which is not a Hong Kong ship, and would, were the ship a Hong Kong ship, constitute an indictable offence under the law of Hong Kong, shall constitute that offence: Crimes Ordinance (Cap 200) s 23B (2). A person shall not, without lawful excuse, place on board, or cause to be placed on board, or possess on board, a vessel within the waters of Hong Kong a prescribed article; or use a vessel to carry on board the vessel, or use a vessel to tow on board another vessel, a prescribed article within the waters of Hong Kong; or use a vessel to tow otherwise than on board another vessel a prescribed article within the waters of Hong Kong: Import and Export Ordinance (Cap 60) s 6E (1), (3), (4). 指在香港特別行政區範圍內的所有水域，不論該水域是否可供船隻通航：《釋義及通則條例》（第1章） 第3條。指香港的所有內陸水域、領海及感潮水域，亦包括該等水域及領海內的植物群及動物群：《水污染管制條例》（第358章）第 2(1)條。香港水域根據《船舶及港口管制規例》（第313A章）分為不同的範圍： 禁區、保留區和特別碇泊區。環境保護署署長可指定香港水域內某範圍為海洋傾倒物料區、以及就指定為海洋傾倒物料區的範圍在憲報刊登公告：《海上傾倒物料條例》（第466章） 第4及 第7條。任何人（無論該人具有何種公民身分或屬何種國籍）的任何作為如 (a)在香港水域內的船舶上作出，或在該水域內利用船舶進行，而該船舶並非香港船舶；及 (b)在該船舶為香港船舶的情況下，根據香港法律會構成一項可公訴罪行，則該作為均構成該項罪行 ：《刑事罪行條例》（第200章） 第23B(2)條。任何人如無合法辯解，不得在香港水域內的船隻上放置或安排放置或管有訂明物品；或不得在香港水域內，使用船隻在船隻上運載訂明物品，或使用船隻拖動另一艘在其上有訂明物品的船隻；不得在香港水域內，使用船隻拖動另一艘以並非在船隻上的其他方式有訂明物品的船隻：《進出口條例》（第60章）第6E (1)、 (3)及(4)條。 |
