In the context of deeds, something that defeats the operation of a deed, but that, strictly, is contained in some other deed or document: Ex parte Popplewell; Re Storey (1882) 21 Ch D 73 (CA). A defeasance is distinguishable from a ‘condition’ which has a similar effect but is strictly contained in a deed itself: Ex p Popplewell; Re Storey, supra. In modern law and practice, this strict distinction is rarely observed, and ‘defeasance’ and ‘condition’ are used interchangeably. In the context of bill of sale, it means an agreement between the parties to the bill of sale affecting either the right of the grantor to redeem the good or of the grantee to seize them. If a bill of sale is made or given subject to any defeasance not contained in the body thereof, such defeasance shall be deemed to be part of the bill, and shall be written on the same paper or parchment before registration otherwise the registration shall be void: Bills of Sale Ordinance (Cap 20) s 9.
