The normal case of legal possession is where the true owner has de facto possession and intends to exclude unauthorised interference. In this instance de facto and legal possession are associated in the same person: Newcastle City Council v Royal Newcastle Hospital [1959] AC 248, 1 All ER 734 (PC). A bailee also has de facto and legal possession during the bailment: Halsbury’s Laws of Hong Kong, Vol 20, Personal Property [295.012]. De facto possession of goods may be obvious where physical control is demonstrable: [295.011] note 8. The facto possession may mean effective, physical or manual control, or occupation, evidenced by some outward act, as distinct from a legal possession: Hall v Cotton [1986] 3 All ER 332, [1987] QB 504 (DC). A shopkeeper is not necessarily in de facto possession of bank notes which are dropped by a stranger in a part of the shop frequented by customers and picked up by a customer: R v Ng Kam Chuen [1986] HKLR 1202; Bridges v Hawkesworth (1951) 21 LJQB 75. An owner of goods enjoying the full rights of ownership has de facto possession: Fouldes v Willoughby (1841) 8 M & W 540.
