释义	飛機法律責任 Liability for wrongful use of aircraft arising in trespass or nuisance. Aircraft may fly over any property at a height above the ground, which, having regard to wind, weather and all the circumstances of the case, is reasonable, or the ordinary incidents of such flight so long as the law, orders or regulations which are applicable in the particular case are complied with: Civil Aviation Ordinance (Cap 448) s 8(1). Strict liability arises for material loss or damage caused to any person or property on land or water by, or by a person in, or an article or person falling from, an aircraft while in flight, taking off or landing, unless the loss or damage was caused or contributed to by the negligence of the person by whom it was suffered: Civil Aviation Ordinance (Cap 448) s 8(2). See also Airspace; Strict liability. 因侵佔行或滋擾而引致錯誤地使用飛機的法律責任。飛機可在離地面某一高度飛過任何財產，只要該高度是在顧及該情況中的風向、天氣及所有情況下是屬合理的高度，或在顧及該等飛行的一般事宜的情況下屬合理，及符合適用於該次飛行的法律、指令或規例：《民航條例》（第448章）第8(1)條。任何由正在飛行、起飛或著陸的飛機或在其內的人或從其墮下的物件或人，對地上或水上任何人或財產導致實際損失或損毀，須負上嚴格法律責任：《民航條例》（第448章）第8(2)條。另見 Airspace; Strict liability。
